Terms of Use
Effective July 15, 2026
These Terms of Use are a binding agreement between you and Petal Post, operated by its individual developer, Andrew Girard (“Petal Post”, “we”, “us”). By creating an account or using the app or website (together, the “Service”) you accept these terms. If you do not agree, do not use the Service. We’ve kept the language as plain as we can — but every paragraph here is the binding kind, including the arbitration agreement and class-action waiver in the “Disputes” section below.
Who can use Petal Post
Petal Post is for adults: you must be at least 18 years old (and old enough to form a binding agreement where you live) to use the Service. You may not use the Service if you have previously been banned from it. When you sign up you agree to provide accurate information and to keep your sign-in method secure — anything done through your account is treated as done by you. Tell us right away if you believe your account has been compromised.
The Service
Petal Post is a private shared space for exactly two people. Pair only with someone who wants to be there; unpairing and account deletion are always available. The Service evolves: we may add, change, or remove features, and we may suspend or discontinue all or part of the Service (with reasonable notice where practicable). We do not guarantee that the Service, or any particular feature, will always be available, uninterrupted, or error-free.
Your content
What you write belongs to you. You grant Petal Post only the limited, non-exclusive, royalty-free license needed to operate the Service — to host and store your content, transmit and display it to your paired partner, create backups, and process it for features you invoke. This license ends when your content is deleted from the Service, except for the limited backup period described in the Privacy Policy. We claim no other rights to your content, and we do not use it to train AI models.
You are solely responsible for the content you post and for your interactions with your partner. You represent that you have the rights to anything you post.
Acceptable use
Using the Service, you agree NOT to:
- harass, threaten, or abuse anyone, or use the Service to break the law;
- attempt to access another couple’s data, probe or circumvent our security or access controls, or use another person’s account without permission;
- reverse engineer, decompile, or copy the Service or its code except where the law expressly permits it;
- scrape the Service, access it with automated tools, resell it, or abuse rate limits or AI features (including attempts to make AI features act outside their purpose);
- misrepresent your age or identity, or impersonate anyone;
- upload malware or content that infringes someone else’s rights.
We may remove content or suspend accounts that violate these rules.
Communications from us
By creating an account you agree to receive service emails we need to send to operate the Service — sign-in codes, security alerts, and notices about your account or material changes to these terms. We may also occasionally send product updates or announcements; those are optional, and every one includes an unsubscribe link (or email support@petalpost.app and we’ll turn them off). Opting out of optional email never affects your use of the Service.
Feedback
We genuinely read feedback (there’s a form in Settings). If you send us ideas, suggestions, or bug reports, you agree we can use them freely — to fix, improve, or build anything — without restriction, credit, or compensation, and without any confidentiality obligation. Ideas are sometimes independently in progress already; sending feedback doesn’t give you rights in whatever we build.
Our intellectual property
The Service itself — the app, website, code, design, illustrations, name, and logo — is the property of Petal Post or its licensors and is protected by copyright, trademark, and other laws. These terms give you a personal, limited, non-transferable license to use the app; they don’t give you the right to copy the Service, use our name, logo, or art, or create derivative works from them without our written permission. (What you write remains yours — see “Your content” above.)
Copyright complaints
If you believe content on the Service infringes your copyright, email support@petalpost.app with (1) the material you believe is infringed, (2) where the allegedly infringing material appears, (3) your contact information, and (4) a statement, under penalty of perjury, that you believe in good faith the use is unauthorized and that you are the rights holder or authorized to act for them. We will respond to valid notices, including removing material where appropriate.
Subscriptions & billing
Petal Post is free to use. Optional premium features (the AI “magic”) are offered as an auto-renewing subscription purchased through Apple. The price and billing period are shown before you buy. Payment is charged to your Apple ID, and the subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your device’s Settings → your Apple ID → Subscriptions; deleting the app or your account does not by itself cancel a subscription. All billing, and any refunds, are handled by Apple under Apple’s terms — we cannot issue refunds for purchases made through Apple. A subscription bought by either partner unlocks premium features for both of you while it remains active. Prices may change; changes apply only to future billing periods and Apple will notify you as its rules require. Premium features are subject to fair-use limits.
AI features
AI suggestions (date plans, recipe import, conversation questions, gift ideas, monthly letters) are generated by a machine-learning model. They can be inaccurate, incomplete, odd, or unavailable, and they are provided for inspiration only. Use your own judgment — especially for anything involving food (allergies, ingredients, cooking safety), travel, health, money, or safety. You are responsible for how you act on AI output.
Petal Post is not counseling
Petal Post is an app for sharing everyday life with your partner. It is not therapy, counseling, or medical, mental-health, legal, or financial advice, and it is not a substitute for any of those. If you or someone you know is in crisis, contact local emergency services or a crisis line (in the US, call or text 988).
Third-party content & services
Movie data comes from TMDB (this product uses the TMDB API but is not endorsed or certified by TMDB); place data comes from OpenStreetMap (© OpenStreetMap contributors). Links out of the app (maps, recipe sites, Yelp) go to third-party services with their own terms and policies, which we don’t control and aren’t responsible for.
App Store terms
When you use Petal Post on an Apple device: the app is licensed to you, not sold, for use on Apple-branded devices you own or control, per the App Store terms. These Terms are between you and us — not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for the app, its content, or any claims relating to it (including product liability, legal or regulatory compliance, consumer protection, or IP claims); those are our responsibility. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo or designated a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties. You agree to comply with applicable third-party agreements (like your wireless data plan) when using the app.
Ending things
You can stop using the Service or delete your account (Settings → Delete account) at any time; deletion is immediate and permanent and closes the shared space (see the Privacy Policy for exactly what is erased). We may suspend or terminate your access if you violate these terms, abuse the Service, or where required by law — with notice where practicable. On termination your license to use the Service ends; sections that by their nature should survive (Your content licenses already ended, Disclaimers, Limitation of liability, Indemnification, Disputes, and this sentence) survive.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL NEVER BE LOST — KEEP COPIES OF ANYTHING IRREPLACEABLE. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (1) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR RELATIONSHIP OUTCOMES, EVEN IF ADVISED OF THE POSSIBILITY; AND (2) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS (US$50). Nothing in these terms limits liability that cannot lawfully be limited (some jurisdictions do not allow certain limitations, so some of the above may not apply to you).
Indemnification
You agree to defend, indemnify, and hold harmless Petal Post and its developer from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service in violation of these terms, or your violation of law or the rights of another person.
Disputes: arbitration & class-action waiver
Please read this section carefully — it affects your rights. If you have a problem, talk to us first: email support@petalpost.app with a description of the dispute, and we’ll try in good faith to resolve it informally within 60 days. If we can’t, you and Petal Post agree that any dispute arising out of these terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small-claims court, or seek injunctive relief for infringement or misuse of intellectual property or data. The arbitration will be conducted in English, by one arbitrator, remotely or in the county where you live. You and Petal Post each waive the right to a jury trial and to participate in a class action, class arbitration, or representative proceeding. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) proceeds in court. Opt-out: you may reject this arbitration agreement, with no effect on the rest of these terms, by emailing support@petalpost.app with the subject “Arbitration opt-out” within 30 days of first accepting these terms. The Federal Arbitration Act governs this section.
Governing law
These terms, and any dispute not subject to arbitration, are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-law rules, and such disputes will be brought in the state or federal courts located in South Carolina — except where the law of your place of residence gives you mandatory consumer protections, which remain yours.
Everything else
These terms (with the Privacy Policy) are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remain in effect. Our not enforcing a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a transfer of the Service (your data protections travel with it). We may update these terms; material changes will be noted in the app before they take effect, and continuing to use Petal Post after that means you accept them. Questions: support@petalpost.app.
